Moore v. Contra Costa College Dist.

Have you ever had an employee who wanted to work more? More hours, more overtime? Robert Moore says he's this kind of guy and that Contra Costa College prevented him from becoming a full time employee, denied him the opportunity to work overtime and attempted to demote him because of his race or gender in violation of Title VII of the Civil Rights Act of 1964.

In a motion to dismiss before Chief Magistrate Maria Elena James, the College argued that Moore had in fact been granted overtime at least once and this should nullify that count of his complaint. Judge James disagreed, finding no case or regulation to support that proposition.

The other counts were dismissed for being time barred.
